LIMITED WARRANTY ON SHIBUMI SHADE, INC. PRODUCTS
& RETURN POLICY

 

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

 

Shibumi Shade Limited warranty:

Shibumi Shade, Inc. (“Shibumi Shade”) takes pride in the products we make and we warrant to the person who originally purchased the product (“you”) that Shibumi Shade Classic or Shibumi Shade Mini products (“Shade Products”), “wind assist” products (“Wind Assist Products”), and beach towels (“Towel Products” and together with the Shade Products and Wind Assist Products, the “Products”) will be free from defects in workmanship and materials for their applicable Warranty Period (outlined below), subject to the below conditions and limitations. This limited warranty does not extend to any subsequent owner or other transferee of the Products. 

This limited warranty only applies to Products purchased from our website, an authorized retailer, or Amazon.com. We require proof of purchase that includes the date of purchase to process any warranty claim.

 

Warranty Period/Remedies:

 This limited warranty starts on the date of your purchase and lasts for (A) 3 years for Shade Products and (B) 90 days for Wind Assist Products and Towel Products (the "Warranty Period"). If Wind Assist Products or Towel Products do not comply with the above limited warranty and you contact us during the applicable Warranty Period, we will replace the Wind Assist Product or Towel Product free of charge.  If the Shade Products do not comply with the above limited warranty and you contact us during the applicable Warranty Period, we will replace either a defective canopy or a defective pole, or both, of the Shade Product free of charge. A canopy may be replaced if it has a large rip or frayed ends. A set of poles may be replaced if they have a crack or break. The Warranty Period will not be extended if we make any replacement and we will not replace more than one pole or one canopy of a Shade Product during the Warranty Period. 

We will make every effort to replace limited edition or discontinued Products but cannot guarantee their availability for replacement. Any limited edition or discontinued Product still under its applicable Warranty Period that cannot be replaced with an identical Product will be replaced with a similar or equivalent model or color based on availability.

We may make changes to Products and designs in between the time you purchased your Product and submitted a warranty claim. Products replaced under this limited warranty may or may not incorporate these changes.

Shibumi Shade’s sole obligation under this limited warranty shall be replacement of non-conforming Products.

To make a warranty claim, you must contact our Customer Service Department by completing the form at https://shibumishade.com/pages/contact during the applicable Warranty Period to initiate a replacement.

 

Warranty Limitations:

This limited warranty does NOT cover any damage caused by the use of third-party accessory products – that is, any accessory products (including but not limited to “wind assist” or “no wind” kits) obtained from sources other than Shibumi Shade.

This limited warranty is VOID if the Products are used for commercial purposes (rentals).

Damages caused by any of the following are NOT considered defects under this limited warranty:

  • Your failure to use a Product as intended and in accordance with the Product’s care instructions;
  • Third-party modifications, repairs or replacement parts;
  • Normal wear and tear;
  • Natural breakdown of colors and materials over extended time or use; or
  • External causes such as accidents, abuse, or other actions or events beyond our reasonable control.

     

    WARRANTY DISCLAIMER:

    THERE ARE NO EXPRESS WARRANTIES OTHER THAN THE LIMITED WARRANTY SET FORTH HEREIN. ANY IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. 

    SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. 

    THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. UNDER NO CIRCUMSTANCES, WHETHER FOR BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, OR OTHER TORT, OR ANY STRICT LIABILITY THEORY, WILL SHIBUMI SHADE BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. 

    SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

    The warranty is only available in the United States. No Shibumi Shade reseller or agent is authorized to make any modification, extension, or addition to this limited warranty.

     

    Return Policy:

    Purchases made from our website, www.shibumishade.com, are eligible for return for a full refund as follows:  

    • Shade Products and Wind Assist Products may be returned up to one year from purchase; and
    • Towel Products may be returned up to 30 days from purchase. 

      To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.  

      Purchases made from a retail location or Amazon.com are subject to the retail location or Amazon.com return policies and Shibumi Shade will not accept returns for Products purchased from retail locations or Amazon.com. Please refer to retailers or Amazon.com for their up-to-date return policies.
